End User License Agreement

1. License Grant and Restrictions

1.1 License Grant

Subject to your compliance with this Agreement, the Developer grants you a limited, non-exclusive, non-transferable, revocable license to download, install, and use the App for your personal, non-commercial purposes on a single mobile device that you own or control.

1.2 Restrictions

You shall not:

• Modify, adapt, translate, or create derivative works based upon the App or any part thereof;
• Decompile, reverse engineer, disassemble, or otherwise attempt to derive the source code of the App;
• Remove, alter, or obscure any proprietary notices on the App;
• Use the App for any illegal purpose or in any manner that is inconsistent with this Agreement;
• Use the App to infringe upon the rights of others;
• Distribute, lease, license, sell, rent, or otherwise transfer the App to any third party;
• Use the App to transmit any viruses, worms, defects, Trojan horses, or other items of a destructive nature.

2. In-App Purchases and Subscriptions

2.1 In-App Purchases

The App may offer the opportunity to purchase virtual products, additional features, or content ("In-App Purchases") within the App. All In-App Purchases are final and non-refundable, except as required by applicable law.

2.2 Subscriptions

The App may offer auto-renewing subscriptions. When you purchase a subscription:

• Payment will be charged to your Apple ID or Google Play account at confirmation of purchase.
• Your subscription will automatically renew unless auto-renew is turned off at least 24-hours before the end of the current period.
• Your account will be charged for renewal within 24-hours prior to the end of the current period.
• You can manage your subscriptions and turn off auto-renewal by going to your account settings after purchase.
• Any unused portion of a free trial period, if offered, will be forfeited when you purchase a subscription.

2.3 Price Changes

The Developer reserves the right to change the price of any In-App Purchase or subscription at any time. If the price of a subscription increases, you will be notified and given the opportunity to agree to the new price before your subscription renews.

2.4 Billing and Payment Processing

All billing and payment processing is handled by either Apple (for iOS devices) through the App Store or Google (for Android devices) through Google Play. The Developer does not store or have access to your payment information.

3. Data Collection and Privacy

3.1 Analytics

The App uses Google Firebase Analytics to collect and analyze data about how you use the App. This information helps us improve the App and provide a better user experience. The information collected includes:

• Device information (model, operating system version)
• App usage statistics
• App performance data
• Approximate location (based on IP address)

3.2 Privacy Policy

Your use of the App is also governed by ourPrivacy Policy, which is incorporated into this Agreement by reference.

4. Ownership and Intellectual Property

4.1 Ownership

The App is licensed, not sold, to you. The Developer retains all rights, title, and interest in and to the App, including all intellectual property rights.

4.2 Feedback

If you provide any feedback, suggestions, or ideas about the App to the Developer, the Developer may use such information without obligation to you.

5. Third-Party Services and Content

5.1 Third-Party Services

The App may display, include, or make available third-party content or provide links to third-party websites or services. You acknowledge and agree that the Developer is not responsible for any third-party content, websites, or services.

5.2 App Store and Google Play

You acknowledge and agree that the availability of the App is dependent on the Apple App Store or Google Play from which you received the App. You acknowledge that this Agreement is between you and the Developer and not with Apple or Google.

6. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. THE DEVELOPER DOES NOT WARRANT THAT THE APP WILL FUNCTION UNINTERRUPTED, SECURE, OR AVAILABLE AT ANY PARTICULAR TIME OR LOCATION.

7. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL THE DEVELOPER BE LIABLE FOR ANY SPECIAL, INCIDENTAL, INDIRECT, OR CONSEQUENTIAL DAMAGES WHATSOEVER (INCLUDING, WITHOUT LIMITATION, DAMAGES FOR LOSS OF PROFITS, LOSS OF DATA, BUSINESS INTERRUPTION, OR ANY OTHER COMMERCIAL DAMAGES OR LOSSES) ARISING OUT OF OR RELATED TO YOUR USE OR INABILITY TO USE THE APP, HOWEVER CAUSED, REGARDLESS OF THE THEORY OF LIABILITY AND EVEN IF THE DEVELOPER HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

8. Indemnification

You agree to indemnify, defend, and hold harmless the Developer from and against any claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys' fees) that arise from or relate to your use or misuse of the App or your violation of this Agreement.

9. Term and Termination

9.1 Term

This Agreement is effective until terminated by you or the Developer.

9.2 Termination by You

You may terminate this Agreement at any time by permanently deleting the App from your device.

9.3 Termination by Developer

The Developer may terminate this Agreement at any time without notice if you fail to comply with any term of this Agreement. Upon termination, you must cease all use of the App and delete it from your device.

9.4 Survival

Sections 3, 4, 6, 7, 8, and 10 shall survive any termination of this Agreement.

10. General Provisions

10.1 Entire Agreement

This Agreement constitutes the entire agreement between you and the Developer regarding the App and supersedes all prior or contemporaneous understandings regarding such subject matter.

10.2 Governing Law

This Agreement shall be governed by and construed in accordance with the laws of New Zealand, without regard to its conflict of law principles.

10.3 Severability

If any provision of this Agreement is held to be unenforceable or invalid, such provision shall be changed and interpreted to accomplish the objectives of such provision to the greatest extent possible under applicable law, and the remaining provisions shall continue in full force and effect.

10.4 Waiver

No failure or delay by either party in exercising any right under this Agreement shall constitute a waiver of that right.

10.6 Changes to this Agreement

The Developer reserves the right to modify this Agreement at any time. If we make material changes to this Agreement, we will notify you through the App or by email. Your continued use of the App after such notification constitutes your acceptance of the modified Agreement.
